·         Good afternoon.  Are you currently employed by Neptune Underwater Expeditions?

·         You work as a deckhand correct?

·         Prior to your time as an employee of Neptune, you owned and operated your own boat and business, right?

·         Were you convicted using this business to smuggle drugs into the country, a felony offense?

·         And the amount of drugs was approximately 20 Kilograms of cocaine right?

·         Did you serve 10 months in jail for this felony?

·         You were also convicted of lying to a United States customs official correct?

o   exception 609(a)2 for "establishing the elements of the crime required proving a dishonest act or false statement.”

·         Moving on, you worked aboard the Man of the People for the July 2, 2011 expedition correct?

·         Do you also help Neptune to do dives “profitably”?  

·         On July 5^th of that trip, did you look at Lee Allen’s personal computer?

·         But you did not have permission from Lee Allen to view this laptop did you?

·         And did you report any information you found on the laptop?

·         You did not report this information because you “depend on tips” right?

·         On July 6, you overheard a conversation between Reggie Rogers and Hayden Hathaway correct?

·         And Reggie Rogers explained that Lee Allen was having some difficulty on the previous dives right? 

·         Did Hayden Hathaway reply, “The Allens paid us $20,000. they are going in the water.  End of conversation.”

·         And this was the end of the conversation right?

·         Moving on, you also witnessed Hayden Hathaway check the weather forecast for the July 7^th dive right?

·         You state in your affidavit that the forecast “could not have been on the screen for more than 10 seconds” right?

·         So it was checked very quickly right?

·         And this was on July 6, the day BEFORE the July 7 dive.

·         And that same night, the night before the July 7 dive, Hayden Hathaway brought a bottle of Johnny Walker Blue to dinner isn’t that right?

·         And Hayden Hathaway, Reggie Rogers, Frankie Fernandez, and yourself, all drank that night correct?

·         On July 7, Reggie Rogers was to lead the dive all the way down to the Hepburn wreck, right?

·         You were responsible for preparing all of the dive equipment for the dive that day correct?

·         You've made mistakes before in the preparation of dive equipment right?

·         You were relying on Lee Allen to come to you if the equipment prepared inadequately right?

·         And isn't it true, that in your affidavit, you state that you “cannot be 100% sure that Lee Allen got a back up cylinder?
