What are your initial thoughts about the case?

Hey all. Here I'd like for people to post their initial thoughts about the case. They can be vague (as in "I really feel like it favors the plaintiff over the defense") or very specific. As we get more into the information, I'll be posting more specific topics on here, but for now, I'd just like to get everyone's initial thoughts. I'll get things started a little.
I believe the concept of "recklessness" on the part of Neptune is going to be difficult to prove, given that Lee Allen did not disclose a serious medical condition and misrepresented his/her experience to Neptune. I do, however, believe Neptune violated specific industry standards in their decision to abandon the buddy system and allow Lee Allen to dive. Finally, I see the company's failure to anticipate the weather as very important, given that it lead to the dangerous situation that caused Rogers and Allen to separate.
Also, there's a lot of good "wreckless or wrecklessness" jokes to be had. I strongly encourage their discovery.
