Father Kills Child Molester: Justifiable Homicide?

So, according to this story, this 23 year old father in Texas witnesses an acquantance with his 4 year old daughter, both at least partially naked. He proceeds to beat the man to death, whether by accident or not, with only his fists. As of yet, he has not been charged with any crime. Do you feel this homicide should be charged as such? Some may argue that merely confronting the man "stopped" the sexual assault and that the proceeding beating could be construed as "revenge".
If the story is true as told (since the only witnesses were the child's family), then I believe this falls under a justified homicide. I have absolutely no sympathy for anyone willing to traumatize/sexualize a 4 year old, and the fact that the father actually walked in on it brings it to a completely new level. I would have liked (and if the father wasn't facing such a harrowing, traumatic experience) for the molester to be punished even more or be the face of a public "lesson" for child molesters, but in this case I feel that the situation was reasonable under the circumstances. The fact that the father didn't reach for a weapon with the obvious intent to kill is amazing in itself, to me.
Of course, more details will come out as the investigation carries on, but if all the current facts of the matter are confirmed then I don't think any jury in America, let alone Texas, would convict this father. But, my question to you myUMBC'ers is whether you think this is justified. Is it morally just to let this man off for homicide
