COMPLAINT

We, the students of the University of Maryland, Baltimore County, have read the recommendation by the SGA Election Board, and wish to hold the SGA President and Executive Vice President, Anthony Jankoski and Daniel Amsini, accountable for alleged actions reported during the 2015 SGA Election

FACTS

• The Student Government Association (hereinafter referred to as the “SGA”) of the University of Maryland, Baltimore County held a regular annual election from Monday 20 April 2015 through Thursday 23 April 2015, where Anthony Jankoski and Daniel Amsini (hereinafter referred to as “the Jankoski-Amsini campaign”) were candidates for and were duly elected as SGA President and SGA Executive Vice President, respectively,

• The Jankoski-Amsini Presidential and Executive Vice Presidential campaign has previously been found in violation of Election Board Rule 10 twice, and were subsequently banned from True Grit’s Dining Hall and the University Center (myUMBC posts http://goo.gl/mgca8G and http://goo.gl/pztGLz),

• On April 29th, according to the Election Board, “An administrator from UMBC’s Shady Grove campus contacted the Office of Student Life with further evidence of misconduct in the election...That evidence included testimony from herself, a staff member, and two students. All four report that two students, whom the administrator identified as Bryan England and Anthony Jankoski, repeatedly solicited votes on tablet devices...during the morning period.” (http://goo.gl/obfcau).

• According to the Election Board, “Additional evidence from another Shady Grove administrator suggests similar behavior may have taken place on Thursday, April 23, after the Election Board had officially put the Jankoski-Amsini campaign on notice for repeated violations of Election Rule #10.” (http://goo.gl/obfcau).

• The Election Board rules were made public and clear to all candidates through a mandatory pre-election meeting with the Election Board, which included Presidential Candidate Anthony Jankoski and Executive Vice Presidential Candidate Daniel Amsini,

• The findings of the 2015 SGA Election Board have grave implications for the legitimacy of the election results, and the process of an impeachment trial allows for the determination of confidence in SGA’s Elected Officials and establishes a check on improper governance,

CALL TO ACTION

Whereas under Section 6.2 of the SGA Constitution (found here: http://goo.gl/KncyvW), “All UMBC undergraduates shall have the right to initiate and sign petitions requesting that SGA take any or all of the following actions:

• Impeach any or all of its officers,”

Whereas, according to the SGA Constitution, under Section 5.5.5, “Any SGA Officer may be removed from office through impeachment and conviction on:

• intentional or reckless conduct in violation of SGA’s Guiding Documents, or of any applicable law or UMBC policy, causing harm to UMBC undergraduates; or

• intentional or reckless behavior that brings dishonor or disgrace upon SGA,”

Whereas, under Section 5.5.5 of the SGA Constitution (http://goo.gl/KncyvW), “An impeachment may be initiated by:

• A petition for impeachment signed by at least 5% of all UMBC undergraduates; in which case the Senate shall conduct a trial of the accused, and can remove the accused by a ⅔ vote of the senators present at a meeting”

We, the student body of the University of Maryland, Baltimore County, hereby urge the SGA Senate to start the process of impeachment hearings for the accused President of SGA, Anthony Jankoski, and the SGA Executive Vice President, Daniel Amsini, on the grounds of SGA Constitution Section 5.5.5, and Election Board Rule 10.
