<Title>NIH POLICY UPDATE FOR SUBAWARD AGREEMENTS</Title>

    <div class="html-content"><div><div><div><ul><li><p><span><span>NIH Updated Policy Guidance for Subaward/Consortium Written Agreements </span></span><span> </span></p></li><li><p><span><span>Notice Number: NOT-OD-23-133 </span></span><span> </span></p></li><li><p><span><span><a href="https://grants.nih.gov/grants/guide/notice-files/NOT-OD-23-133.html">https://grants.nih.gov/grants/guide/notice-files/NOT-OD-23-133.html</a></span></span><span> </span></p></li></ul></div><div><p><span><span>Purpose</span><span> </span></span><span> </span></p></div><div><p><span><span>This notice updates the NIH Grants Policy Statement (NIHGPS), Section 15.2, which outlines the requirements for consortium/subaward agreements on NIH-funded grants. These updates will be incorporated into the GPS in the FY24 publication</span></span><span><span>. This updated guidance is effective October 1, 2023.</span></span><span><span> A Federal Register Notice announcing the updates will be posted in the coming weeks.</span></span><span> </span></p></div></div><div><p><a href="https://www.ecfr.gov/current/title-2/subtitle-A/chapter-II/part-200/subpart-D/subject-group-ECFR031321e29ac5bbd/section-200.332" rel="nofollow external" class="bo"><span><span>2 CFR 200.332(a)(5)</span></span></a><span><span> states that subaward agreements must include, “a requirement that the subrecipient permit the pass-through entity and auditors to have access to the subrecipient's records and financial statements as necessary for the pass-through entity to meet the requirements of this part.” In response to HHS Office of Inspector General and Government Accountability Office audits, NIH has </span><span>determined</span><span> that to assure that this requirement is met, NIH finds it necessary to impose a requirement that foreign subrecipients turn over all records to the primary recipient at an agreed upon frequency (e.g., once a quarter, once a month). Therefore, section 15.2 is updated as follows (changes are bold and italicized)</span></span><span> </span></p></div><div><p><span><span>15.2 ADMINISTRATIVE AND OTHER REQUIREMENTS</span></span><span> </span></p></div><div><p><span><span>The following highlights several areas within the consortium relationship that the recipient needs to address with consortium organizations receiving subawards under a grant to ensure compliance with NIH requirements. The requirement for a written agreement addressing these and other areas is specified in this section</span><span>.  </span><span>NIH will not support any agreement that does not meet the </span><span>minimum</span><span> requirements outlined in the written agreement section below (15.2.1). NIH reserves the right to request copies of the written agreement and relevant supporting documentation as needed, as part of its oversight responsibilities. Failure to </span><span>provide</span><span> requested documentation may lead to remedies for noncompliance and potential enforcement actions (see 8.5, Specific award conditions and remedies for noncompliance).</span></span><span> </span></p></div><div><p><span><span>NIH encourages recipients to ask potential subrecipients, at the application stage, to </span><span>submit</span><span> language in their letters of support </span><span>indicating</span><span> their awareness of these requirements and the subrecipient’s willingness to abide by all requirements should an award be issued.</span></span><span> </span></p></div><div><p><span><span>Note that most of these requirements only apply to a recipient’s consortium relationships with sub-recipients. When the relationship is with a vendor that is </span><span>providing</span><span> routine goods and services within </span><span>nor-mal</span><span> business operations that are ancillary to the operation of the research program, the public policy requirements listed below do not apply. Tripp.</a> Dr. Tripp is Vilas Research Professor of Political Science at the University of Wisconsin-Madison. Tripp's research has focused on gender/women and politics, women's movements in Africa, transnational feminism, African politics (with particular reference to Uganda and Tanzania), autocracies in Africa, and on the informal economy in Africa. <Title>FWS/SURE Deadlines for Undergraduate Research Funding</Title>

    <div class="html-content">Dear Colleagues,<div><br></div><div>If you are interested in funding to hire undergraduates to support your scholarly work, please note that two of the annual funding opportunities for this are closing today (FWS) and on August 25th (SURE). Both FWS and SURE are used to hire students for hourly positions.</div><div><br></div><div>The <strong>Federal Work Study (FWS) </strong>program, managed by UMBC Financial Aid and Scholarships,<span> </span><span>funds undergraduates who have been deemed eligible from a standpoint of financial need. Faculty and staff can request the creation of an FWS position. FWS-eligible undergraduates</span><span> then apply to work in the positions that have been posted (i.e., the person who requested the position selects from amongst those who are eligible and apply). For best consideration, FWS positions should be requested by today.</span></div><div><br></div><div>The <strong>Supplement for Undergraduate Research (SURE) </strong>program, managed by the UMBC Office for Research Development, allows faculty members to hire undergraduates who are in their first four semesters at UMBC to support faculty-supervised scholarly work. <Title>Updated Closeout Reporting Guidance</Title>

As always, if you are having trouble with meeting a deadline, reach out to your Grant Accountant for review.<br></div><div><br></div><div><br></div><div><br></div><div><h3>Reporting</h3>
    <p>With few exceptions, every sponsored project will require a number of
     reports during the life of the project and most certainly at its 
    conclusion. Every Principal Investigator should be prepared to submit a 
    final technical report at the very least. The importance of the 
    submission of such a report on a timely basis cannot be overstated. In a
     grant or contract arrangement, unlike a gift, the sponsor expects and 
    deserves to be informed of results. Negligence by the Principal 
    Investigator may substantially impact their (and the University's) 
    ability to receive other support from the sponsor; it will also result 
    in a loss of payment to the University for costs already incurred. Such 
    losses could become a liability chargeable to the department and 
    college.</p>
    <p>In addition to the technical report(s), other reports may be required
     relating to fiscal data, voucher/invoice submissions and assignment and
     releases. These reports are the responsibility of the Office of 
    Contract and Grant Accounting (OCGA). While the exact deadline for 
    submitting the report is agency specific, the typical range for 
    submission of final reports is either 30, 60, 90, or 120 days after the 
    project end date. To ensure compliance with these sponsored award 
    established fiscal deadlines, OCGA requests a final expenditure 
    certification from the PI or designee 15 - 30 days prior to the required
     submission date of the final financial report/invoice. For example:</p>

    <p>Submit the <a href="https://cga.umbc.edu/final-expenditure-certification-template-for-departments/" rel="nofollow external" class="bo">Final Expenditure Certification Template for Departments,</a>,
     located on OCGA's website, by email to the assigned Grant Accountant. 
    Many interim technical reports also require financial data. Coordinate 
    with the assigned OCGA Grant Accountant to obtain this financial 
    information, if needed.</p>
    <p>Statements of Inventions will be coordinated through the Office of 
    Technology Commercialization with PI input. Equipment accountability 
    will be coordinated through OSP and Inventory Control, with the 
    Principal Investigator's input.</p></div></div>

After reviewing payroll charges, work with your business managers if any changes are needed. Payroll cost transfers (retros) should be processed prior to certification of Effort Reports as retros will reopen any previously certified effort due to adjustments.</span></p><p><span>To find out whether you have open effort reports for Spring 2023 (see page 6, Year: 2023 Period: Spring) and to learn how to certify them, see the attached Effort Report Quick Guide with screenshots for your convenience.
