<Title>Department of Justice-UMBC Agreement</Title>

    <div class="html-content"><p><span><span>Dear UMBC Community,</span></span></p><p><span><span>Today,</span></span><span> <span>UMBC voluntarily entered into an agreement with the U.S. Department of Justice that will bring meaningful improvements to the university’s work to prevent and respond to reports of sexual misconduct and sex discrimination under Title IX. This agreement concludes the DOJ investigation of UMBC’s Title IX compliance, the findings of which were announced on March 18. If you have not already viewed </span></span><a href="https://umbc.edu/dojagreement/" rel="nofollow external" class="bo"><span>my letter and video message</span></a><span><span> about the DOJ’s findings, which focused on the period 2015-2020, I encourage you to do so.</span></span></p><p><span><span>The agreement we signed today commits UMBC to implement measures to enhance the strength, accountability, and independence of the university’s Title IX office; provide specific support for student-athletes and the Athletics Department staff who serve them; expand training for students and employees to improve UMBC’s prevention and response to sex discrimination; and provide financial relief to certain current and former members of the Men’s and Women’s Swimming and Diving team, as determined by the DOJ. The agreement requires regular reporting by UMBC to the DOJ and will remain in effect through the 2028-2029 academic year. <a href="https://umbc.edu/wp-content/uploads/2024/04/DOJ-UMBC-Settlement-Agreement.pdf" rel="nofollow external" class="bo">You can read the full agreement here.</a></span></span></p><p><span>Many of the agreement’s provisions are already under way. In the agreement, the DOJ acknowledges the significant steps the university has taken recently to help prevent and strengthen our response to sex discrimination and sexual misconduct. Those efforts have enhanced our Title IX reporting structures and procedures, expanded training and prevention initiatives, and provided additional support and resources to students and employees. The work is ongoing, and it has included the following improvements since my tenure began in 2022:</span></p><ul><li><span>Created the role of and hired a Vice President for Institutional Equity and Chief Diversity Officer to oversee the work of the Office of Equity and Civil Rights, which is well on its way to being staffed with five full-time, permanent positions, including a Director and Title IX Coordinator, Training and Prevention Manager, Case Manager, and two investigators</span></li><li>Restructured the Office of Equity and Civil Rights to provide greater access and privacy for students and employees</li><li>Appointed an external specialist to provide interim Title IX expertise</li><li>Updated the Title IX website and developed targeted educational resources</li><li>Undertook the process of strengthening the university’s Title IX and anti-discrimination policies and procedures</li><li>Launched an annual mandatory online Title IX training module for all students</li><li>Implemented mandatory reporter training for employees</li><li>Expanded Title IX training for all athletics staff, coaches, and student-athletes</li></ul><p><span>Those efforts, combined with the additional measures to which we have committed in the agreement, will help us better serve our students and all members of the UMBC community.     <div class="html-content"><p>Dear UMBC Community,</p><p>I write to you today to communicate about some significant changes at the leadership level of the university. I felt it was important to share this information with you, as well as our plans for navigating the changes, both in the short term and the long term. </p><p><strong>Director of Athletics</strong></p><p>Very soon, we will launch a national search for a new director of athletics, as Brian Barrio is no longer serving in the role. I have met with the Athletics Department staff—both administrative staff and coaches—and many student-athletes to discuss this transition and assure them of my continued support. As a search gets under way, I have asked two members of the administrative team to take on temporary co-leadership of the department. Whitney Ames, associate athletic director for compliance, and Rich Franchak, senior associate athletic director for business and finance, will be serving in this capacity. Thank you, Whitney and Rich, for your dedication and leadership.</p><p><strong>Vice President for Government Relations and Community Affairs</strong></p><p>Candace Dodson-Reed has resigned from her role leading government relations and community affairs. Yaakov “Jake” Weissmann ’06, who has been serving as associate vice president for government and community affairs, is stepping in to lead the office. A veteran of Maryland state politics, Jake served as chief of staff for two state senate presidents and as assistant chief administrative officer for Montgomery County Executive Marc Elrich before joining UMBC last year. He has already proven to be an outstanding and expert colleague and advisor, and I am grateful for his service to UMBC. </p><p><strong>Vice President for Institutional Advancement</strong></p><p>Greg Simmons is departing from his role leading advancement for UMBC. We will move quickly to conduct a national search, and we will update you on that process soon. In the near term, we are grateful to Stanyell Odom, director of alumni engagement, and Kim Robinson, director of major gifts, who have agreed to provide temporary management and leadership of the division and its operations. We know this is a busy time of year for our advancement colleagues, so we felt it was critical to designate key leaders who could serve as point people for their colleagues in the division and who would have a direct line of communication to me and others in senior leadership. Thank you, Stanyell and Kim, for serving in these roles. </p><p><strong>Office of the General Counsel  </strong></p><p>Our search for a general counsel, following last year’s retirement of David Gleason, is under way, and I expect to name a new chief legal advisor for the university in the near future. Bobbie Hoye, who had been serving as the point of contact for the Office of the General Counsel, has left her role as senior associate general counsel.</p><p>These transitions are significant, and they follow other changes in our senior leadership personnel and structure since I arrived at UMBC in August 2022. I understand some may worry that such transitions will be destabilizing for UMBC, and I know the impact of these transitions is in many cases felt personally, not just operationally or institutionally. I assure you that we will work to move UMBC as swiftly as possible through this period while attending thoughtfully to stability, continuity, and care for the community. </p><p>Universities, many of them centuries old, have a remarkable capacity to endure and evolve through all manner of demands, challenges, and opportunities. UMBC may be younger than many of its peers, but it is no less remarkable in its ability to grow, adapt, renew, and rise to any challenge. In the weeks and months ahead, we will celebrate our graduates who make us so proud, and we will welcome the newest members of Retriever Nation from around the state and around the world. They have placed their trust, and their futures, in UMBC because they recognize that we are a dynamic public research university that is dedicated to inclusive excellence in everything we do. I have every confidence we are worthy of their trust and will exceed their ambitious expectations.</p><p>The mission and values of this institution are strong and sure.     <div class="html-content"><span><p><span>Dear UMBC Community,</span></p><p><span>As we welcome students and faculty back to classes and look ahead to the remainder of the semester, I hope that everyone found some time to rest and recharge over Spring Break. I know that for many in our community, last week brought difficult news, as the U.S. Department of Justice (DOJ) released the findings of its three-year Title IX investigation into the university.</span></p><p><span>If you have not yet </span><a href="https://my3.my.umbc.edu/groups/announcements/posts/140035" rel="nofollow external" class="bo"><span>read the letter or watched the video</span></a><span> I shared with the UMBC community when the DOJ made its findings public last Monday, I ask you to do so. Please read the findings if you are able to—understanding that they are deeply disturbing. The DOJ found yearslong failures in the university’s response to allegations of sexual misconduct and sex discrimination in the Department of Athletics during the period 2015-2020. </span></p><p><span>As our community reckons with what happened in the past, we resolve to move forward in addressing the problems, rebuilding trust, and strengthening this community. Please know that in all of our work, the safety and well-being of our community members are my highest priority, and always will be.  </span></p><p><span>We are committed to creating and sustaining a culture that is safe and responsive to the needs of our community. This includes providing support services and resources to those who may have experienced trauma, or for whom these investigative findings are difficult to process. We have identified a host of </span><a href="https://umbc.edu/dojagreement/#support" rel="nofollow external" class="bo"><span>resources</span></a><span> to help support you through this difficult time, and we encourage anyone in our community—students, faculty, and staff—to reach out for support if needed. That agreement will specify critical changes in the way the university responds to reports of sexual misconduct and sex discrimination. Our work is already well underway, and we have made important progress since I arrived in 2022: strengthening our Title IX structures, processes, and policies; appointing a new Vice President of Institutional Equity and Chief Diversity Officer; creating the Office of Equity and Civil Rights (ECR), which oversees all Title IX compliance; and building an expert team of dedicated staff in that office. This week, in fact, ECR is welcoming two new full-time staff members to support the critical work of Title IX investigation and response.</span></p><p><span>We are strong, and I believe we will come out of this even stronger. I remain deeply inspired by the privilege of being in service to all of you and this extraordinary institution. <Title>Important News Concerning Title IX Compliance</Title>

Today, the United States Department of Justice (DOJ) released the findings of its Title IX investigation into the university. The DOJ investigation spanned more than three years, beginning in November 2020, and focused on the period 2015-2020. The findings are deeply troubling. The DOJ found failures in the university’s response to allegations of sex discrimination during that period. We take full responsibility for what happened, and we commit ourselves not only to addressing the failures, but also to rebuilding our community’s trust. </span></p><p><span>Title IX prohibits discrimination based on sex in educational programs and activities that receive federal funding. The DOJ determined that in the years 2015-2020, the university failed to comply with Title IX by not properly responding to allegations that the former head coach of the men’s and women’s swimming and diving teams engaged in sexual misconduct and discrimination against student-athletes. I know it will be difficult to read the full findings of the investigation, but it is important to do so if you are able, because understanding and acknowledging the findings will allow our community to begin the work of moving forward. The DOJ’s complete findings are available </span><a href="https://umbc.edu/wp-content/uploads/2024/03/2024-3-18-DOJ-Notice-Ltr.-to-UMBC.pdf" rel="nofollow external" class="bo"><span>here</span></a><span>. </span></p><p><span>To the students who were harmed: I am profoundly sorry. I am grateful for the courage and strength of those who spoke up and took action, and I am committed to ensuring that such failures never happen again. UMBC let you down, and we let our community down. We did not live up to our values, and that is inexcusable. </span></p><p><span>Let me say also that we did not want to share this information during spring break, while so much of our community is not with us here on campus. The timing of this news is regrettable, because we know that our ability to provide care and support is hampered when we are apart, and that it will be difficult for some to receive this information while separated from their UMBC networks and support systems. The DOJ chose to release the information this week, in accordance with its practice of releasing findings as soon as possible upon finalizing them. </span></p><p><span>Throughout this investigation, UMBC fully cooperated with the DOJ. We provided documents, made witnesses available for interviews, and responded to every request for information and access. An agreement with the DOJ will be signed and shared publicly in the coming days. It will specify critical changes in the way the university responds to reports of sexual misconduct and discrimination.</span></p><p><span>But please know that we are not waiting for the agreement to be signed to act. Soon after I arrived at UMBC in August 2022, I created the role of Vice President for Institutional Equity and Chief Diversity Officer to oversee  the work of the Office of Equity and Civil Rights. Tanyka M. Barber was hired into this role, and she has initiated mandatory Title IX training for all students, as well as training for faculty and staff; conducted a thorough review of the university’s Title IX policies and procedures; and reached out to students and staff to provide them with the resources that they need. She is working quickly yet thoughtfully to build an experienced and expert team and transform our Title IX processes to make them more comprehensive and accessible to ensure that the university responds appropriately to complaints. </span></p><p><span>We have also reset the Athletic Department’s structure, governance, and reporting mechanisms, starting with making the athletic director a direct report to me. Together, these actions represent an important and necessary set of first steps; there is much more work to do.  </span></p><p><span>The failures between 2015 and 2020 identified by the DOJ were the collective responsibility of many individuals. Those who were identified as failing to comply with their Title IX obligations—whether through action or inaction—will be held accountable. </span></p><p><span>This is a painful moment for UMBC, but I am inspired by all of you and privileged to be in service to this beloved community. Every day, I am awed by students, faculty, and staff who show up every day to work together, learn, and support one another to do more and to achieve great things. You have remained true to our mission, and you live our core values of inclusive excellence, collaboration, innovation, and impact. I am grateful to each one of you for continuing to make UMBC exceptional. We are all better for it. </span></p><p><span>Now, it is our turn to show up for you.</span></p><p><span>Going forward, we will – and we MUST – hold ourselves to the highest standards of care, safety, integrity, and compliance.     <div class="html-content"><div>Dear UMBC Community, </div><div> </div><div>I write to share the news that Kathy Dettloff, vice president for administration and finance at UMBC, will be leaving her role, effective June 15. We are grateful to Kathy for her dedicated service to UMBC, which began in 2019 as associate vice president for financial services and continued when she assumed the role of vice president in January 2022. </div><div> </div><div>As the financial management and planning lead for the university, Kathy has been responsible for the development of our budget, as well as for a wide portfolio of university operations, including facilities management, emergency management, and the university’s Police Department. She is also responsible for all administrative services and human resources functions and has served with dedication on many committees across the university and as a liaison with the University System of Maryland and various state officials and agencies. </div><div> </div><div>In all her work, Kathy’s devotion to UMBC and her passion for the university’s mission have shone through—as has her diverse knowledge, developed over her career in this field. Prior to coming to UMBC, Kathy served as vice president of finance and budget and associate treasurer at Rutgers University and as chief budget officer at the University of Delaware. Her career has also included various positions of increasing responsibility at Johns Hopkins University. </div><div> </div><div>I know the UMBC community joins me in gratitude for Kathy’s service, including her tireless work throughout the COVID-19 pandemic, as well as on a number of key projects for our campus. In one of those, she demonstrated her hands-on leadership style in providing guidance and support to her team and colleagues as they addressed the extensive damage caused by historic weather events on Christmas Day 2022.</div><div> </div><div>As we move toward a national search for a new vice president, we will announce an interim leadership plan shortly. Please know we are committed to ensuring a smooth transition and continuity of operations. My deepest appreciation to Kathy for all she has contributed to UMBC.     <div class="html-content"><div>Dear UMBC Community, </div><div> </div><div>We write today to once again address the need for respect and civility among our community. This comes as we are hearing reports and seeing for ourselves incidents of disrespectful behavior and antisemitic messages posted across campus and on social media. These include conduct during a recent Student Government Association (SGA) meeting and recent student demonstrations on campus and antisemitic posters displayed in violation of our university posting policy. </div><div> </div><div>We will hold accountable those who violate university policy, and we encourage the continued reporting of any incidents of harassment or bias through the Office of Equity and Civil Rights’ <a href="https://ecr.umbc.edu/report/" rel="nofollow external" class="bo">online reporting form</a>, by emailing <a href="mailto:ecr@umbc.edu">ecr@umbc.edu</a>, or by calling 410-455-1717. We also want to remind the entire community that the freedom for individuals to express themselves is not absolute: All members of the community—students, faculty, and staff—are expected to adhere to university policies and procedures, including UMBC’s <a href="https://ecr.umbc.edu/discrimination-policy/" rel="nofollow external" class="bo">policy on discrimination and equal opportunity</a>. We will not tolerate speech or behavior that creates a hostile environment for others or that denies or limits individuals’ access to our educational programs or activities on the basis of race, religion, national origin, or other protected categories. </div><div> </div><div>The behavior of some individuals at last week’s SGA meeting was particularly disappointing. The meeting was held to address a resolution that asked the university to boycott and divest from “entities complicit in the violation of Palestinian human rights” and to actively protect “Palestinian students and their allies as they advocate for justice for the Palestinian people.” Although SGA leadership asked audience members to respect our community standards and provided specific expectations for the meeting, some in the audience chose to engage in behaviors that were unacceptable—disrespectful to those testifying, as well as to the SGA. For the SGA to truly represent the undergraduate student body and advocate for it within our system of shared governance, its processes must allow for a multitude of voices and viewpoints to be heard and considered—not silenced by peers. </div><div> </div><div>Campus Life staff is actively and regularly engaged with SGA and will continue to support its members as they remain dedicated to their roles in shared governance. Additionally, we continue to work with our religious organizations and Religious Council to provide care and support and co-create a vision for the future that builds bridges across communities of differing beliefs and identities. With regard to campus protests and demonstrations, we have improved and clarified our safety protocols to ensure the well-being of all community members. And our student conduct and community standards team stands ready to address violations of the student code of conduct, including behaviors that disrupt the functioning of the university and that target specific individuals or threaten the physical safety of community members. </div><div> </div><div>To foster greater understanding of the First Amendment-protected freedom of speech, we are providing educational sessions for students, faculty, and staff. Sessions for student leaders begin today, Monday, March 11, and we will offer additional sessions throughout the semester. We remind all community members that as we prioritize a culture of safety, security, and well-being for <em>everyone</em>, our university policies serve to guide us in how we exercise our rights to free speech and expression on campus. The right to free speech and expression on campus comes with both responsibilities and limits. UMBC community members and external visitors are required to adhere to applicable university policies and procedures.</div><div><br></div><div>We have recently received multiple reports of vandalism on campus and posters in facilities that are not approved for posting. As noted in the <a href="https://www2.umbc.edu/policies/pdfs/UMBC%20Policy%20On%20The%20Posting%20of%20Notices%20and%20Event%20Roadway%20and%20Footpath%20Signage.pdf" rel="nofollow external" class="bo">posting policy</a>, areas of the university that are not designated for the posting of advertisements and notices include, but are not limited to, the interior of classroom spaces, light poles, brick facades, trees, fences, public tables/chairs, windows, vending machines, benches, doors, and vehicles. We encourage you to review this policy to understand what is and is not approved, and the consequences for violations of the policy and its associated procedures for students and employees. </div><div><br></div><div>Some of these postings were also reported as offensive and not in line with our collective commitment to inclusion and belonging. Times are challenging and many of us are hurting. UMBC is committed to creating a welcoming community for all, one that honors and supports each person's experiences and identities.     <div class="html-content"><div>Dear UMBC Community, </div><div><br></div><div>To enhance vehicle security on campus, the UMBC Police Department will provide steering wheel locks free of charge to students, faculty, and staff who own Hondas or Infinitis. This initiative follows a recent nationwide uptick in break-ins and thefts, as well as thefts of airbags and catalytic converters. Locally, Hondas have become a particular target, with the driver's side window being broken and airbags being stolen from steering wheels. </div><div><br></div><div>UMBC Police will distribute steering wheel locks and other safety enhancements on a first-come, first-served basis from 10 a.m. to 3 p.m. starting today, February 9, and continuing next week, February 12 through 16. Please bring your vehicle to the trailer located in the back of Parking Lot 8 and be prepared to show your registration and UMBC ID. </div><div><br></div><div>Additionally, vehicle owners are advised to take the following precautions:</div><div><br></div><div><ul><li>Never leave keys inside the vehicle.</li><li>Ensure the vehicle's doors are locked and windows fully closed.</li><li>Opt for well-lit parking areas whenever possible.</li><li>Avoid parking adjacent to large vehicles.</li><li>Refrain from leaving valuables in the car; keep them out of sight.</li><li>Use a steering wheel lock.</li><li>Hyundai and Kia have released anti-theft software updates for affected models. <Title>UMBC Police Seeks Community Input for Reaccreditation</Title>

    <div class="html-content"><div>The UMBC Police Department will be assessed by the Commission on Accreditation for Law Enforcement Agencies, Inc. (CALEA) February 12 through February 14, 2024. An assessor will examine all aspects of our policy and procedures, management, operations, and support services to verify our compliance with professional standards.</div><div> </div><div>The assessment is part of the voluntary process required to achieve accreditation, a highly prized recognition of law enforcement professional excellence. UMBC Police achieved initial accreditation in 2016 and reaccreditation in 2020.</div><div>  </div><div>As part of the assessment, and on an ongoing basis, university employees and members of the community are invited to offer comments related to the department's compliance with professional standards, engagement in the service community, delivery of public safety services, and overall candidacy for accredited status.</div><div> </div><div>Public comment can be given via the CALEA portal on the UMBC Police <a href="https://police.umbc.edu/about-us/contact-us/" rel="nofollow external" class="bo">website</a> or <a href="https://cimrs2.calea.org/276" rel="nofollow external" class="bo">submitted directly.</a> </div><div> </div><div>An <a href="https://www.calea.org/" rel="nofollow external" class="bo">overview of the CALEA process</a>, including the <a href="https://www.calea.org/node/11406" rel="nofollow external" class="bo">titles of standards,</a> is accessible for your review.
